Acceptable Use Policy

1. GENERAL

   1. You agree not to:

      1. use the Services in any unlawful or fraudulent manner;

      2. use the Services to access or collect data that is illegal in any state or country where you reside or engage in commercial activity; 

      3. use the Service to access or collect personal data in violation of applicable Data Protection Law; 

      4. license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service available to any third party, other than authorized Agents in furtherance of your internal business purposes as expressly permitted by the Terms;

      5. use the Service to process data on behalf of any third party, unless the third party is also subject to the Terms;

      6. use Screenshots to access, collect or process personal data, copyrighted material, and/or illegal content; 

      7. use the Services in any manner which infringes on any person’s or entity’s rights, including intellectual property rights; 

      8. use the Services to access or collect data that could be classified as material non-public information in violation of the applicable securities regulation laws, if you are using the Service to make investment decisions.

      9. use the Service to access, connect to or retrieve data from any third party system, service or sites where You explicitly agree to terms of service prohibiting Your manner of access to, connection to or retrieval and/or use of data from the system, service or site;

      10. attempt to or use the Service to scrape any data from LinkedIn’s website; 

      11. use the Services to access or collect data relating to illegal gambling, terrorism, narcotics, arms or weapons, adult content/pornography or violence; or 

      12. falsely imply any sponsorship or association with Zyte or engage in any action or practice that reflects poorly on Zyte or otherwise disparages or devalues Zyte’s reputation or goodwill. 

2. USE OF SERVICE DATA AND/OR DATA FEEDS 

   1. You agree not to:

      1. use Service Data and/or Data Feeds in any unlawful or fraudulent manner;

      2. use Service Data and/or Data Feeds in any manner which infringes on any person’s or entity’s rights, including intellectual property rights; or

      3. license, sublicense, sell, resell, rent, lease, transfer, assign, distribute, time share or otherwise commercially exploit or make the Service Data and/or Data Feeds available to any third party, other than authorized Agents in furtherance of Your internal business purposes as expressly permitted by the Terms and this AUP.

3. MALICIOUS OR ABUSIVE ACTIVITY

   1. You agree not to:

      1. use the Services in a manner that materially interferes with a website’s normal operations;

      2. use the Services to post, transmit, upload, link to, send or store any viruses, malware, worm, back door, trap door, Trojan horses, time bombs, or any other harmful software or limiting routine; 

      3. generate fraudulent impressions of or fraudulent clicks on advertisements (your or third-party) through any automated, deceptive, fraudulent or other means, including but not limited to through repeated manual clicks, the use of robots, agents or other automated query tools and/or computer-generated search requests, and/or the unauthorized use of other search engine optimization services and/or software; or

      4. use the Services to post, transmit, upload, link to, send or store any content that is unlawful, hateful, violent, abusive, libellous, obscene, discriminatory, or otherwise inappropriate content, unless it is for law enforcement purposes that have been approved in writing by Zyte.

4. SECURITY AND SYSTEM INTEGRITY 

   1. You agree not to:

      1. create fraudulent accounts;

      2. modify, adapt, or hack the Services or otherwise attempt to gain unauthorized access to the Services or related systems or networks;

      3. probe, scan or test the vulnerability of the Site or any network connected to the Site, nor breach security or authentication measures used on the Site or any network connected to the Site;

      4. use the Service in any manner that interferes with or disrupts the integrity or performance of the Services and its components; or

      5. attempt to decipher, decompile, reverse engineer or otherwise discover the source code of any of the Services or Software.

5. ARTIFICIAL INTELLIGENCE

   1. You agree to use the Services in compliance with all applicable laws and regulations relating to the development, deployment and/or use of artificial intelligence systems in any applicable jurisdiction, including the Artificial Intelligence Act (Regulation (EU) 2024/1689) (the “EU AI Act”).

   2. You agree not to use the Services, Service Data or Data Feeds to build or support an artificial intelligence system which may be considered a ‘Prohibited’ or ‘High Risk’ system under the EU AI Act, including (but not limited to):

      1. systems that deploy subliminal, manipulative, or deceptive techniques to distort behaviour and impair informed decision-making;

      2. systems that exploit a person’s or group of persons’ vulnerabilities;

      3. systems relating to biometric categorisation, biometric identification, social scoring or profiling;

      4. systems relating to facial recognition;

      5. systems used for law enforcement, military, or border control purposes;

      6. systems used to support critical infrastructure or essential public or private services;

      7. systems used for recruitment, selection or evaluation of candidates or other employment purposes; and

      8. systems used for the administration of justice or democratic processes.

6. Permitted Use

You may use the Services only for lawful purposes and in accordance with the Terms and this AUP. The features must be used as intended by the Service documentation.

7. Changes to this Policy

We may update this AUP from time to time. Continued use of the Services after changes become effective constitutes acceptance of the revised AUP.
